Arbitration is an agreement between two or more parties to have a neutral person or panel of such decide the issues for them, much like a judge. Usually, parties agree to arbitration in advance of a dispute by way of specific language in a contract.
However, you can still agree to arbitration after a dispute arises.
Ideally, all involved parties will agree on an arbitrator together.
If you can’t, you have three choices:
1. Ask a third party to select the arbitrator.
2. Apply to a court for a judge to select the arbitrator.
3. Create a three-person arbitration panel where each party selects an arbitrator, and then the two arbitrators select a third arbitrator.
You may choose the panel of arbitrators if your dispute is especially complicated.
